Income Tax Implications on Closing One Housing Loan Account and availing another houseing loan for construction.

Housing Loan Assessee are provided with the leased accommodation by his/her employer and probably he may not be receiving the House Rent Allowance (HRA).

For the mass benefit, we are elaborating the provision related to availability of deduction to the salaried assessee towards the rent payment.

Assessee receiving HRA from Employer:
Salaried Assessees who are in receipt of HRA from an employer can claim an exemption u/s 10(13A) of the Income Tax Act-1961 read with Rule 2A of the Income Tax Rules, 1962. The least of following can be claimed as deduction u/s 10(13A):-
  • An amount equal to 50% of salary, where the residential house is situated at Bombay, Calcutta, Delhi or Madras and an amount equal to 40% of salary where residential house is situated at any other place;
  • House rent allowance received by the employee in respect of the period during which the rental accommodation is occupied by the employee during the previous year; or
  • The excess of rent paid over 10% of salary.
Following points need to be taken in to consideration while calculating the amount of HRA admissible as exemption u/s 10(13A):
  • “Salary” for the purpose of computation of exemptions u/s 10(13A) means Basic Salary and includes Dearness Allowance if terms of employment so provide. It also includes commission based on a fixed percentage of turnover achieved by an employee as per the terms of contract of employment AND EXCLUDES ALL OTHER ALLOWANCE & PERQUISITE.
  • Exemption is not available where an employee lives in his own house, or in a house for which he doesn’t pay any rent.
Assessee not receiving HRA:
Any individual who is not in receipt of HRA from the employer can claim deduction towards rent payment for residential accommodation u/s. 80GG of the Income Tax Act.

The condition precedents for deduction u/s 80GG are as under:
  • He has to prepare a declaration in Form No.10BA.
  • He or his minor child, spouse or HUF of which he is a member, should not be owner of a house at the place where he ordinarily resides or performs his duties; or he should not be owner of any house at any other place, the income therefrom is to be determined under section 23(2) (a) or, as the case may be, under section 23(4) (a) (i.e., income from self-occupied house property).
Subject to compliance of the other stipulations mentioned above, housing loan assessee can claim deduction towards the rent paid for residential accommodation.

Exempted from Income Tax Interest or Concessional Loans.

Interest free or concessional loans: 

It is common practice, particularly in financial institutions, to provide interest free or concessional loans to employees or any member of his household. The value of perquisite arising from such loans would be the excess of interest payable at prescribed interest rate over interest, if any, actually paid by the employee or any member of his household. The prescribed interest rate would now be the rate charged per annum by the State Bank of India as on the 1st day of the relevant financial year in respect of loans of same type and for the same purpose advanced by it to the general public. Perquisite value would be calculated on the basis of the maximum outstanding monthly balance method. For valuing perquisites under this rule, any other method of calculation and adjustment otherwise adopted by the employer shall not be relevant.


However, small loans up to Rs. 20,000/- in the aggregate are exempt. Loans for medical treatment specified in Rule 3A are also exempt, provided the amount of loan for medical reimbursement is not reimbursed under any medical insurance scheme. Where any medical insurance reimbursement is received, the perquisite value at the prescribed rate shall be charged from the date of reimbursement on the amount reimbursed, but not repaid against the outstanding loan taken specifically for this purpose.

The interest rates vary only slightly from the normal lending rates of the banks.

How to Save Income Tax & Established Property from House Loan ?

Under this section maximum of Rs.150000(1.5 lac) can be declared as the interest payable on the Home Loans. As we have shown the examples, here as well the rule is same. You can exempt maximum of Rs.150000.

Tax Benefits on Home Improvement Loans:
  1. The good thing is you can claim the tax benefits for home improvements loan as like the home loans.
  2. There is an income tax benefit on the interest component of the home improvement loan up to Rs 30,000 under Section 24 of the Income Tax Act, if it is self occupied.
  3. In case of the property is rented out, there is no limit on the tax deduction. For example if you have to pay the total interest on the home improvements loan as Rs.195000. The total income from the rented house is Rs.100000. Then you will be eligible for the tax deduction of Rs.95000 (195000-100000). Note that this exemption is not coming under the allowed limit of Rs.150000 for home loans interest. That is the separate component on income tax act.

Complete Education Loan Procedure of Various Nationalize Banks in India

Many Nationalize Banks of India provides its customers with a variety of personal banking services, which of them one is education loans to students aspiring to continue higher eduction or studies in India or through out the India. The Study Loans are sanctioned only to Indian Nationals.

As per the Bank's terms & conditions the Courses are Eligible for Education Loans:


A candidate, who applies for a program with prospects of employment, can apply for the loan. Whether you apply for a graduate, professional or postgraduate program or any other course sanctioned by UGC, AICTE or the government, you will be considered eligible for the loan.
Expenses taken into account:

* The student loan covers school, college or hostel fees as well as cost for buying books and other necessary items.
* Apart from the library, exam or library fees, even caution deposit, refundable deposit and building fund are considered for the loan.
* Other expenses, which are mandatory for completing the course, travel expense as well as a maximum cost of Rd 50,000 for buying a 2 wheeler, are taken into account.

Quantum of Loan & Security:


An applicant is sanctioned a loan of maximum Rs 10 lacs for studying in India and Rs 20 lacs for studying in abroad. On a loan above Rs 4 lacs, there is a margin of 5% and 15% for studying in India and abroad respectively.

* No security is required for loan amount upto Rs 4 lacs.
* A borrower should present a 3rd party as guarantee for a loan amount above Rs 4 lacs. However, on SBI discretion, this clause of 3rd party guarantee may be waived off in certain cases.
* If you borrow a loan amount above Rs 7.5 lacs, you need to offer a material collateral security and assign the future income of the student for paying installments.
* The guardians or parents of a borrowing student should secure an education loan.
* If the borrower is married, his or her spouse, parents-in-law or parents can act as the co-obligator.


Repayment of Education Loan:


The borrower can begin repaying 6 months after getting job or one year after the course is completed, whichever happens earlier. The loan can be repaid in a period of 5 to 7 years.

Education Loan for ISM students:


Education loans are also offered to the students of ISB. An ISB student can borrow upto 95% of costs. There is also a margin of 5% on the loan amount, which needs to be repaid in 7 years.
