Wife has right to know husband’s salary.

New Delhi: Wives of government servants have a “right” to know salary particulars of their husbands and these details should also be made public by their offices as mandated under suo-moto disclosure clause of the RTI Act, the Central information Commission has held.

Information Commissioner M Sridhar Acharyulu said every spouse has a right to information about the salary particulars of the other especially for the purpose of maintenance.

“More so, wife has a right to know the salary particulars of the husband, who is an employee of the public authority,” he said.

The commissioner further said that the details about a government employee’s salary is no third party information and these have to be voluntarily disclosed under Section 4(1)(b)(x) of the RTI Act.

He said the salary paid to the public authority is sourced from the tax paid by the people in general and it has to be disclosed mandatorily under the RTI section.

“The information about the salary of employee or an officer of the same public authority cannot be considered as a third party information… Public authorities cannot reject such RTI applications about salary under the pretext of the third party information,” he held.

Acharyulu warned the Home Department of Delhi government that such denial of information will be wrongful and could incur penalty. The warning was in context of an application filed by Jyoti Seherawat seeking salary slip of her husband who is employed at the Home (General) department.

The information was denied as her husband gave in written to the department that such an information should not be provided to anyone.

Legally, How to take wife’s Income Tax Return Copy ?

Friends, as you know that if a wife take Interim Maintenance from Husband, but wife submit their Income Tax Return to Income Tax Department, in that case the copy of Income Tax return is must need to relief from Interim Maintenance and that’s why every DivorcĂ©e Person need help to get a copy of wife's IT returns as filed with the IT department, to submit the same to the Hon’ble court for Interim Maintenance (IM) application under the DV Act. The facts are as follows:

1. Have definite information that she has filed different sets of numbers with the IT dept and the Hon’ble court and has therefore committed perjury to mislead the Hon’ble court and export money from me.

2. Her application for IM has already been dismissed by the Hon’ble Family court on the grounds that she has enough income to maintain herself and that she is highly educated (B.Com, LLB)

3. Her turnover in stock trading for the current year is around Rs. 19 crores ( yes that's 19 crores - up by almost 450% from the previous years)

4. She has however filed papers with the Hon’ble court to claim that her income has gone down by 55% compared to the previous years and claimed she only has interest income for about Rs. 1 lakh.

5. My application for issue of witness summons to the IT dept has been dismissed by the Hon’ble court on the grounds that the same is not required at this stage as the IM will be decided on the basis on prima facie evidence and action if any for the false and fabricated tax returns can be taken under the penal code and Income Tax Act.
