CBDT Extended due date for Filing of Income Tax Return to 7th Nov. 2017 for A.Y. 2017-18

Recently, CBDT has extend the date of Income Tax Return Filing for Asstt. Year 2017-18 from 31.08.2017 to 07.11.2017.

On consideration of representations from various stakeholders for further extension of due date, being 30th September, 2017 for assessees covered under clause (a) of Explanation 2 of section 139(1) of the Income Tax Act, 1961 pertaining to Assessment year 2017-18, the CBDT in modification of its order dated 31.08.2017 in the file of even number, hereby further extends the "due-date" for filing income-tax returns and reports of audit pertaining to Assessment Year 2017-2018 from 31st October, 2017 to 7th November, 2017.

Recently Government has extend the last date for filing of GSTR-2 and GSTR-3 for July, 2017 to 30th Nov., 2017 and 11th December 2017 respectively in order to give more time to taxpayers and businesses for filing the return

In this regard Government will be issued a notification soon - to facilitate about 30.81 lakh taxpayers for filing GSTR-2 for month of July, 2017.

Last Date of 2nd Quarter TDS Return is 31st October, 2017

We all are well known about TDS Quarter Return. Annually 4 Quarters are filed by TDS Deductor i.e. April-June (1st Quarter), July-September (2nd Quarter), October-December (3rd Quarter) and January-March (4th Quarter).  Now, the time is 2nd Quarter filing of return i.e. July-September on or before 31st October because the last date of 2nd Quarter for filing for Fin. Year 2017-18. File on time and avoid unwarranted penalties and default notice.

With the introduction of Section 234E, there is now a provision of stringent penalties for delayed filing of TDS returns.

  • Failure to submit e-TDS Statement on time will result in fees on the deductor.
  • If you delay or forget to file your e-TDS Statement, fees of Rs. 200 per day will be levied on the deductor, as long as TDS Statement is not filed.
  • The levied amount of fee is not supposed to exceed the TDS deductibles.
  • Prior to filing of TDS Statement such fee should be paid and it should be reflected in the TDS Statement

Dated: 31st of March, 2017 Clarifications on the Taxation and Investment Regime for Pradhan Mantri Garib Kalyan Yojana, 2016

The Taxation and Investment Regime for Pradhan Mantri Garib Kalyan Yojana, 2016 (hereinafter ‘the Scheme’) has commenced on 17.12.2016 and is open for declarations  upto 31.03.2017.

2. Representations have been received from various stakeholders regarding difficulties in uploading   of declaration   in Form   No.1 under   the   Scheme. Instances   have   been communicated wherein despite making payment of tax, surcharge, penalty and deposit under the  Scheme,  Challan  Identification  Number  / deposit  reference  number  with  respect  to  the payment  of  tax,  surcharge,  penalty  and  depositunder the  Scheme has  not  been  provided  by the banks. Consequently, the assessees are unable to upload Form No.1.

3.Considering the rush in banks during last days of financial year, which also happens to be the last date of filing declaration under the Scheme, CBDT has decided that if an assessee has made payment of tax, surcharge, penalty and deposit under the Scheme, in the banks by the  closing  hours  of  31st March,  2017,  he shall be  allowed  to file  declaration  in  Form No.1 under the Scheme by the 10th of April, 2017.

Maximum Penalty of Rs. 10000 on Delay in Filing of Income Tax Returns

Delay in filing Income Tax returns will now attract fine upto Rs 10,000

For income below Rs. 5 lakh, filing returns after July will attract a fine of Rs. 1,000, while for income above Rs. 5 lakh it will be Rs. 5,000, if it is filed after the due date but on or before December 31 of the assessment year.

The Budget has proposed imposing a fine for not filing income tax returns within the due date. For income below Rs. 5 lakh, filing returns after July will attract a fine of Rs. 1,000, while for income above Rs. 5 lakh it will be Rs. 5,000, if it is filed after the due date but on or before December 31 of the assessment year. It has also proposed a fee of Rs. 10,000 in any other case.

At a post-Budget event organised by the Institute of Chartered Accountants of India, Hasmukh Adhia, revenue secretary said that those who have an income of Rs. 5 lakh and above and file returns after July but till December will face a fine of Rs. 5,000. “This fine will be raised to Rs. 10,000 if the return is filled after December,” he said.

Time limit for filing revised return reduced
Under Section 139(5) of the Income Tax Act, an assessee can file revised return within two years from the end of the relevant fiscal year or before the completion of assessment by tax authorities, whichever is earlier. The Finance Bill proposes to reduce the time limit for filing such revised return to one year from the end of relevant fiscal year or before the completion of the assessment by tax authorities, whichever is earlier. This amendment shall be effective from fiscal year 2017-18.

A revised return can be filed if the assessee has filed the return within the due date. For filing the revised return, one has to enter the acknowledgement number and the date of filing of the original return in the revised form.

The Budget has also proposed to reduce the time limit for completion of assessment under Section 153 of the I-T Act. In assessment year 2018-19, it will be 18 months from the end of the assessment year. From assessment year 2019-20, it will be 12 months from the end of the assessment year. It has also reduced the time limit for completion of re-assessment. In respect of notices served under Section 148 of the I-T Act on or after April 1, 2019, the time limit for completion of assessment or re-assessment will be 12 months from the end of the financial year in which the notice is served.

Interest on refund
Under Section 244(A) of the I-T Act, an assessee is entitled to receive interest on refund because of excess payment of advance tax, tax deducted or collected at source. The assessee will, in addition to the refund amount, will receive simple interest on such refund at the rate of 1.5% for every month or part of a month from the date on which claim for refund is made in the returns or in case of an order passed in appeal, from the date on which the tax is paid to the date on which refund is granted.

In partial modification to this department’s Circular No.17 of 2016-17 on the subject cited above and in exercise of the powers conferred under Rule 49A of the Delhi Value Added Tax Rules, 2005, I,H. Rajesh Prasad, Commissioner, Value Added Tax, do hereby extend the last date of filing of online/hard copy of second quarter return for the year 2016-17, in Form DVAT-16, DVAT-17 and DVAT-48 along with required annexure/enclosures to 21/11/2016

However, the tax due shall continue to be paid in the usual manner as per the provisions of section 3(4) of the Delhi Value Added Tax Act, 2004. The dealers filing the returns through digital signature need not file hard copy of the return/Form D AT-56.

Process of tax reform will continue says - FM

FM: Process of Tax Reforms will continue and pending GST issues will be resolved soon.

Finance Minister Shri Arun Jaitley inaugurates the Two Day Economic Editors Conference in New Delhi 

The Union Minister for Finance and Corporate Affairs, Shri Arun Jaitley said that the Government has endeavoured its best to take a number of decisions through a consensus route for the overall growth of the economy during the last two and half years. He said that the present NDA government took over under adverse global circumstances and its challenge was to re-establish the credibility of economic decision making process. But, the Government did not shy away from it and in the larger interest of the country, it tried its best to take as much decisions as possible even at risk but in the overall public interest and to speed-up the growth of the economy. The Finance Minister Shri Jaitley was delivering the Inaugural Address after inaugurating the two day Economic Editors Conference (EEC)-2016, here today.

Referring to the recent decisions taken by the Government, the Union Finance Minister Shri Jaitley said that the different sections of the economy have been opened-up for foreign investment, procedures were simplified and every effort was made to ease the environment for doing business in India. The Finance Minister said that the Government recognises the role of market forces in the economy that is why the role of Government discretion in decision making process,whether in case of auction of coal blocks or spectrum etc., was deliberately minimized.

Shri Jaitley said that the Government is working on tax reforms including Goods and Services Tax (GST). Shri Jaitley further said that the Government has initiated a series of measures to ensure that the State subsidies reach the most deserving. He said that the major issues have been resolved and GST will be implemented by April 1st 2017, besides this, parallel reforms are also in the pipe line in direct tax structure. He said tax collection this year is reasonably good, there is spurt in public expenditure and local demand is increasing. Hence there will be positive impact of recent decision of demonetising of higher value currency notes. He assured that people making small deposits for exchanging old currency notes will not be harassed. 

Appreciating Press Information Bureau’s efforts for providing an opportunity to Regional Editors for direct interaction with the decision makers in the Government, Shri Jaitley said that Press Information Bureau has been extremely effective in handling the Government’s communication.

Earlier welcoming the Union Finance Minister, Senior officers and Editors from across the country and other participants, the Director General of Press Information Bureau(PIB), Shri Frank Noronha said that the main objective of the Conference is to provide a platform for interaction between the Senior Finance Journalists from different regions of the country and the Ministers and senior functionaries of the Government of India on key economic issues.  He expressed hope that the Conference would also help in acquiring different perspectives of the relevant context and background behind a particular initiative of the Government. He further said that this exercise of media outreach will pave the way for better and informed perceptions which in turn will benefit and empower people through various columns and reports of the participating media delegates.

The two day conference is being organised by Press Information Bureau in collaboration with the Ministry of Finance. The Main objective of the Economic Editors Conference is to apprise the media persons about the major policy initiatives, achievements and future roadmaps of different core Economic Ministries of the Government of India.  Economic Editors from different parts of the country, along with Bureau Chiefs and Business Correspondents from Delhi are participating in this conference. Besides the Ministry of Finance, Ministries of Commerce & Industry, Railways, Road Transport and Highways, Petroleum and Natural Gas, Urban Development, Information Technology and Niti Aayog, among others are participating. 

The Directorate of Advertising and Audio-Visual Publicity (DAVP) has also put an exhibition on the occasion on “70 years of India’s Independence’’.

Order under Section 119 of the Income-Tax Act, 1961

In order to mitigate the difficulties being faced by the taxpayers in the State of Jammu and Kashmir in filing income tax returns and reports of audit for Assessment Year 216-2017 by the "due date", as prescribed under section 139(1) of Income-tax Act, 1961, the CBDT, hereby extends the "due date" for filing income tax returns and reports of audit under
the provisions of Income-tax act pertaining to Assessment Year 2016-17 for all categories of taxpares in the state of Jammu and Kashmir to 31st December, 2016.

Important Due Dates in the Month of August, 2016

Due Date for filing of Income Tax Return extended for Asstt. Year 2016-17

Recently, CBDT has issued a press information on 29th July, 2016 regarding extension of due date for filing of Income Tax Return for Asstt. Year 2016-17 i.e. from 31st July, 2016 to 5th August, 2016.  The details are as under :

As per provisions of Section 139(1) of Income-tax Act 1961, Central Board of Direct Taxes extends the due date for filing returns of Income for Assessment Year 2016- 2017 from 31st July, 2016 to 5th August,2016 , in case of taxpayers throughout India who are liable to file their Income-tax by 31st July, 2016.

This extension is given in order to avoid any inconvenience to the taxpayers while making payment of taxes pertaining to returns of income for Assessment Year 2016- 2017 by 31st July, 2016 due to reports of Bank strike on 29th July,2016(Friday) and 31st July,2016 (Sunday), being a Bank-Holiday.

Due date extension in J & K is 31.08.2016

As per provisions of Section 119 of Income-tax Act, 1961(‘Act’) , Central Board of Direct Taxes extends the due date for filing income-tax returns from 31st July, 2016 to 31st August ,2016 , in case of Income-tax assessees in the State of Jammu & Kashmir who are required to file their return under Section 139(1) of the Act. This extension is given on consideration of reports of dislocation of general life in certain areas of the State of Jammu & Kashmir.

We all are searching Important Deadlines for Asstt. Year 2016-17 because just ended Financial Year 2015-16.  A lot of Tax Calendars on internet but they did not satisfied me therefore, I search many important related sites for the same and placed this post.  The date of closing of Accounting period for Financial Year 2015-16 regarding Individual, HUF and Corporate taxpayers as well as others are as under :

Individual taxpayers (including self-employed individuals managing businesses, agricultural and forestry farms) receive their Pre-Completed Tax Return forms in April.

4 April
  • Last date to file the income tax return of self-employed individuals, businesses and sole proprietorships including its enclosures (many individuals have either 4 May or 13 May as the date for sending back the form, check what is printed on the form itself). However, if there is nothing to add or correct, you do not have to send back your Pre-Completed Tax Return form.
  • Tax Return on the Web for the self-employed shuts down.
5 April
  • February 2016 reporting on construction details must arrive to the Tax Administration.
7 April
  • ​Due date for deposit of Tax collected for the month of March, 2016. However, all sum collected by an office of the government shall be paid to the credit of the Central Government on the same day where tax is paid without production of an Income-tax Challan
  • Due date for furnishing of challan-cum-statement in respect of tax deducted under Section 194-IA in the month of March, 2016
  • February 2016 VAT, seafarer employer's contributions and Lottery tax:  If Periodic tax returns are submitted on paper forms, this is the last date when they must arrive in the tax office.
  • March 2016 employer's contributions, other withheld taxes and source taxes and Tax on insurance premiums:  If Periodic tax returns are submitted on paper forms, this is the last date when they must arrive in the tax office.
12 April
  • February 2016 VAT, seafarer employer's contributions and Lottery tax: Last date for electronic filing of Periodic tax returns, due date for tax payment.
  • March 2016 employer's contributions, other withheld taxes and source taxes and Tax on insurance premiums: Last date for electronic filing of Periodic tax returns, due date for tax payment.

TDS/TCS - Income Tax Returns and Due Date for Asstt. Year 2016-17

It is mandatory for every taxpayer to communicate the details of his income to the Income-tax Department. These details  are to be furnished in the prescribed form known as return of income. In this part, you can gain knowledge about the various provisions relating to return of income.

Person required to file the return of income
The provisions relating to filing of return of income depend upon the status of the taxpayer. The position in this regard is given below:

In the case of companies:
Every person, being a company, has to file its return of income compulsorily, irrespective of its income being profit or loss. In other words, it is mandatory for every company to file the return of income irrespective of its income or loss.

In the case of partnership firms:
Every person, being a partnership firm (including Limited Liability Partnership), has to file its return of income compulsorily, irrespective of its income being profit or loss. In other words, it is mandatory for every partnership firm to file the return of income irrespective of its income or loss.

In the case of an Individual / HUF / AOP / BOI / Artificial Juridical Person :
Every individual/HUF/AOP/BOI/artificial juridical person has to file the return of income if his total income (including income of any other person in respect of which he is assessable) without giving effect to the provisions of section 10A, 10B or 10BA or Chapter VIA (i.e., deduction under section 80C to 80U), exceeds the maximum amount which is not chargeable to tax i.e. exceeds the exemption limit.

In the case of charitable or religious trusts:
Every person in receipt of income derived from property held under charitable or religious trusts/legal obligations or in receipt of income being voluntary contributions referred to in section 2(24)(iia), has to file the return of income if its total income without giving effect to the provisions of sections 11 and 12 exceeds the maximum amount not chargeable to income-tax.

In the case of political parties:
The Chief Executive Officer of every political party has to file the return of income of the party if the total income of the party without giving effect to the provisions of section 13A exceeds the maximum amount not chargeable to income-tax.

In the case of certain associations :
Following entities are liable to file the return of income if their total income without giving effect to the provisions of section 10 exceeds the maximum amount not chargeable to tax:
  • Research association referred to in section 10(21)
  • News agency referred to in section 10(22B)
  • Association or institution referred to in section 10(23A)
  • Institution referred to in section 10(23B)
  • Fund/institution/trust/university/other educational institution/any hospital/medical institution referred to in sub-clause (iiiad), (iiiae), (iv), (v), (vi) or (via) of section 10(23C)
  • Mutual Fund referred to in clause (23D) of section 10
  • Securitisation trust referred to in clause (23DA) of section 10
  • Venture capital company or venture capital fund referred to in clause (23FB) of section 10;
  • Trade union/association referred to in sub-clause (a) or (b) of section 10(24)
  • Body/authority/Board/Trust/Commission referred to in section 10(46)
  • Infrastructure debt fund referred to in section 10(47)
In the case of certain university, college or other institution:
Every university, college or other institution referred to in clause (ii) and clause (iii) of section 35(1), which is not required to furnish return of income or loss under any other provision of the Act, shall furnish the return of income every year, irrespective of income (or) loss.

In the case of Business Trust
Every business trust, which is not required to furnish return of income or loss under any other provision of the Act, shall furnish the return of income every year, irrespective of income (or) loss.

In the case of persons holding assets located outside India:
Every person being a resident [other than not ordinarily resident in India], has to furnish his return of income even if he is not required to furnish a return of income as per the provisions discussed above, if during the year he has any asset (including any financial interest in any entity) located outside India or signing authority in any account located outside India.
