CBDT issued 2nd Round Appreciation Certificates to Tax Payers for Asstt. Year 2016-17

Sub: CBDT issues second round of Certificates of Appreciation to tax payers for their contribution towards Nation building.

The Honourable Finance Minister Shri Arun Jaitley, had personally handed over certificates to a few individuals at North Block to commence the program of taxpayer appreciation on 19th September, 2016. The Central Board of Direct Taxes has sent out such certificates of appreciation to 8.43 Lakh individual tax payers by e-mail in the following categories on the basis of the taxes paid by them for the Assessment Year 2016-17 :

i. Platinum : Tax contributed Rs. 1 Crore and above
ii. Gold : Tax contributed Rs. 50 Lakh to Rs. 1 Crore
iii. Silver : Tax contributed Rs. 10 Lakh to Rs.50 Lakh
iv. Bronze : Tax contributed Rs. 1 Lakh to Rs.10 Lakh

Taxpayers have lauded this new initiative and have reacted with pride and satisfaction that their contribution towards spending on various infrastructure development, social sector & welfare schemes out of revenues mobilized through tax payments have been acknowledged.

In continuation of the initiative, CBDT has started issuing the second round of Certificates to another 10.15 Lakh tax payers. While the earlier set of certificates had mostly included individuals who e-verified their returns, the second phase will cover those individuals who have filed their returns within the due date and their ITR-V has been received well before the 120 day period for submission provided under the Income Tax Act.

The CBDT urges taxpayers to e-file their returns in time and verify their return by submitting the Electronic Verification Code online or sending their ITR-V within the 120 day period so that they can also be acknowledged for their contribution. The Department is committed to continuous improvement of taxpayer services and seeks the cooperation of all taxpayers in contributing their fair share of taxes voluntarily.

Sub: Finance Minister conveys Government’s Appreciation to tax payers for their contribution towards Nation building.

The Government acknowledges the contribution of individual tax payers in paying taxes within the prescribed time and prompt filing of Income Tax Returns. The Honourable Finance Minister, Shri Arun Jaitley today handed over certificates of appreciation issued by CBDT honoring select tax payers for such contribution. While it is widely acknowledged that the Nation meets its obligations towards spending in various social sector and welfare schemes and infrastructure development out of revenues mobilized through tax payments by millions of honest tax payers, this step marks the first effort by the Government to directly communicate to the tax payer its appreciation for that contribution.

CBDT will be sending out such certificates of appreciation to individual tax payers by e-mail in various categories on the basis of the level of taxes paid by them for the current Assessment Year 2016-17 where taxes have been paid in full and tax payers have no outstanding tax liabilities and where the return is e-filed within the prescribed due date. The tax payers may display these certificates in their homes / offices.

The categories for individual taxpayers and the number of certificates being issued in the first round are:

i. Platinum : Tax contributed Rs. 1 Crore and above
ii. Gold : Tax contributed Rs. 50Lakh to Rs. 1 Crore
iii. Silver : Tax contributed Rs. 10Lakh to Rs.50 Lakh

CPC (TDS) advisory for use of Digital Signatures on TRACES

The Centralized Processing Cell (TDS) has released a new feature on its web-portal TRACES, where a Digital Signature Certificate (DSC) can be used for availing various services offered by the portal.

You are advised to take note of the following key information in this regard:
  • Under Information Technology Act, 2000, a "Digital Signature" means authentication of any electronic record by a subscriber by means of an electronic method or procedure in accordance with the provisions of section 3.
  • The Digital Signature keeps record of the person who is availing the facility.
  • Please exercise caution in use of Digital Signature and should not be shared in any circumstances. If shared, the person using DSC shall also be liable to consequences.
  • In accordance with the Information Technology Act, 2000, every subscriber shall exercise reasonable care to retain control of the private key corresponding to the public key listed in his Digital Signature Certificate and take all steps to prevent its disclosure to a person not authorised to affix the digital signature of the subscriber.
  • TRACES has provided facility for Admin and Sub-users to facilitate authorised Sub-users to carry out activities on TRACES and submit to the Admin user. The Admin user has the rights to approve the activities using the DSC.
  • It is therefore, advised to refrain from using the Digital Signature of any person other than the Authorised Person appointed by the deductor, for carrying out any activity on TRACES.
Please note that the "Authorised Person" is referred to as "Person Responsible" in accordance with Section 204 read with Section 200 of the Income Tax Act, 1961 and other relevant provisions for deduction of tax.

All about Online TDS Return Correction & more without Digital Signature.

CPC (TDS) provides with enhanced features, to further add to the convenience of online facility of filing corrections to the TDS Statements. With this feature, you will be able to submit Online Corrections at TRACES without even having a Digital Signature. Currently over 20,000 deductors are already using the online facility for corrections.

To avail the facility, it is requested to Login to TRACES and navigate to “Defaults” tab to locate “Request for Correction” from the drop-down list. Click to “Proceed” in absence of Digital Signature.

Pre-requisites for filing online Corrections:

  • Digital Signature is not mandatory to be registered on TRACES for raising online corrections.
  • Only Challan Correction is permissible in absence of Digital Signature. Digital Signature enables you to carry out PAN Corrections as well.
  • Correct KYC information needs to be submitted for the purpose of validation.
  • Online request can be submitted, only if there is a regular statement already filed and processed.
  • All previous corrections pertaining to the statement should have been processed and the processing status can be verified from the Dashboard.

Functionalities available without Digital Signature:

  • Challan/BIN Correction
  • A list of all Matched and Unmatched challans can be viewed by clicking the appropriate tab.
  • Matched challans can be corrected for “Amount Claimed as Interest and Others”. Please note that Matched challans cannot be tagged.
  • Unmatched challans can be corrected and tagged to Deductee rows in the statement.
  • In addition, NO CHALLAN, which has been used for other purposes outside the system, should be tagged.
  • The corrections to above challans can be reset by clicking the Reset tab, if this requires to be further corrected.
Additional Functionalities available with Digital Signature:

PAN Correction

  • Invalid to Valid PAN: The correct name of the Valid PAN will be displayed in “Name as per changed PAN”.
  • Valid to Valid PAN: If the new PAN entered is Invalid, a message is displayed in the “Action Status”. Please note that there is only one opportunity for a Valid to Valid PAN correction.
  • All the corrected rows can be viewed by clicking on “Show Edited Rows” on the screen

Action Summary:

  • After carrying out all the corrections, Action Summary can be referred for all changes carried out.
  • Please click “Confirm” for all intended changes and the statement is ready for submission.

Actions to complete Submission:

  • Please navigate to “Defaults” tab to locate “Corrections Ready for Submission
  • Click on “Submit for Processing”, which will prompt to digitally sign the submission.
  • Once the correction is submitted successfully, a Token Number for the same will be available

When DSC of organization expires or organization want to change the DSC, then organization is required to put up a request for renewal or updation of DSC with NSDL. The following documents are requisite for renewal / updation of Digital Signature Certificate (DSC):

Taxpayers to get digital signatures for E-filing of I-T returns - IT

In order to weed out the hassle of sending by post a hard copy of e-filed return, the Income Tax department has decided to bring in the facility of electronic signatures for taxpayers to endorse their bonafides.

The Central Board of Direct Taxes (CBDT), the apex office to formulate policies for the Income Tax department, has decided to implement the new mechanism by the end of the next financial year in March, 2015.

Official sources privy to the development told that the CBDT will get in touch with the Union Ministries of Law and Communications and Information Technology to establish the legal position and technology requirements respectively before it operationalises the new protocols for the e-returns called 'ITRV'.

"It has to be seen what will be the procedure to obtain electronic or digital signature by the taxpayers. There should not be an additional cost or procedural burden for the taxpayer who opts to file his or her I-T return online," a senior official said.

In case of digital signatures (used by corporate entities as of now), a bonafide statement that verifies the identity of the sender, it is required to be created by paying a fee and this requires regular renewal, which is why this is being seen as a burden on salaried class and other categories of small taxpayers.

As per the norms in force at present, a taxpayer who files an e-return has to mandatorily send a copy of the same by post to the I-T department's Central Processing Centre (CPC) in Bengaluru.

However, in many cases the post would not reach the CPC and hence the tax department categorised the taxpayers return as null and void.

The department, sources said, wants to promote e-filing of I-T returns and it desires that e-filing should be "hassle free and sans any glitches", which will prompt more number of people to file their tax returns by this way.

The I-T department is also bolstered by the fact that more and more number of people are opting to file their returns online.

As per existing rules, the CPC, on receipt of the posted 'ITRV', sends an electronic acknowledgement to the tax return filer.

The problem arises when the document sent by post does not reach the CPC because of lapses on the part of the taxpayer or some other reason.

Form 16 / 16A:

  • TDS certificate in Part A of Form 16 shall be generated only for those PANs that have been reported in Annexure II of 24Q statement for 4th Quarter. The deductors are, therefore, advised to ensure that they provide salary details of their employees employed for whole or part of the year in Annexure II of Quarterly TDS Statement for 4th Quarter

Form 26AS:

  • The tax deducted and paid under section 194IA of I T Act can be viewed online by the seller of the immovable property in their Form 26AS (Tax credit statement) from 22nd July, 2013 onwards

Default Processing:

  • Intimations u/s 200A of the Income Tax Act, 1961 for the statements filed during the Financial Year 2012-13 are being sent from TDS CPC
  • Levy u/s 234E of the Income Tax Act, 1961 is a statutory levy and cannot be waived
  • Deductors are advised that the demand raised in the intimation u/s 200A can be closed by making payment and filing the corresponding correction statement

Conso File

  • New file format for Conso File is available in 'Conso File Formats' under 'Quick Links'

Utilities:

  • While generating Form16 / 16A, if you are getting a message as "0 PDF files generated successfully", please download the updated version of the PDF converter utility 1.3L

Miscellaneous:

  • As per CBDT Circular No.07 of 2014, For Government deductors who are mapped to a valid AIN and has done payment of TDS/TCS through book transfer voucher (Book Identification Number-BIN), the due date for filing of TDS/TCS statement for 2nd, 3rd& 4th Quarters of financial year 2012-13 and for 1st, 2nd& 3rd Quarters of financial year 2013-14 has been extended upto 31st March 2014 as per CBDT Circular No.07 of 2014.   • Companies from AY 2010-11 onwards.
  • Any Income Tax Forms filed by assessee, Chartered Accountants, Deductors, etc.
  • Optional for all other assessees.
A DSC should be issued by a licensed Certifying Authority (CA). Certifying Authority (CA) means a person who has been granted a licence to issue a DSC under Section 24 of the Indian Information Technology Act 2000.

There are 3 types of DSCs, having different security levels namely: Class-1, Class-2 , Class-3.

Class 1: These certificates do not hold any legal validity as the validation process is based only on a valid e-mail ID and involves no direct verification.

Class 2: The identity of a person is verified against a trusted, pre-verified database.

Class 3: This is the highest level where the person needs to present himself or herself in front of a Registration Authority (RA) and prove his/ her identity.

For e-Filing, Class-2 and Class-3 DSCs are accepted.

A DSC should be issued by a Licensed Certifying Authority (CA). CA means a person who has been granted a licence to issue a Digital Signature Certificate under Section 24 of the Indian Information Technology Act 2000.

How to Furnish TDS Certificate in Asstt. Year 2013-14?

4.6 Furnishing of Certificate for Tax Deducted (Section 203):
4.6.1 Section 203 requires the DDO to furnish to the employee a certificate in Form 16 detailing the amount of TDS and certain other particulars. The Act stipulates that the Form 16 should be furnished to the employee by 31st May after the end of the financial year in which the income was paid and tax deducted. Even the banks deducting tax at the time of payment of pension are required to issue such certificates. Revised Form 16 annexed to Notification dated 31-5-2010 is enclosed. The certificate in Form 16 shall specify
(a)  Valid permanent account number (PAN) of the deductee;
(b)  Valid tax deduction and collection account number (TAN) of the deductor;
(c)  (i) Book identification number or numbers (BIN) where deposit of tax deducted is without production of challan in case of an office of the Government;
(ii) Challan identification number or numbers (CIN*) in case of payment through bank.
(d)  Receipt numbers of all the relevant quarterly statements in case the statement referred to in clause (i) is for tax deducted at source from income chargeable under the head "Salaries". The receipt number of the quarterly statement is of 8 digit.
It may be noted that under the new TDS procedure, the accuracy and availability of TAN, PAN and receipt number of TDS statement filed by the deductor will be unique identifier for granting online credit for TDS. Hence due care should be taken in filling these particulars.
Due care should be also be taken in indicating correct CIN/ BIN in TDS certificate.
If the DDO fails to issue these certificates to the person concerned, as required by section 203, he will be liable to pay, by way of penalty, under section 272A(2)(g), a sum which shall be Rs. 100/-for every day during which the failure continues.
It is, however, clarified that there is no obligation to issue the TDS certificate in case tax at source is not deductible/deducted by virtue of claims of exemptions and deductions.
4.6.2 If an assessee is employed by more than one employer during the year, each of the employers shall issue Part A of the certificate in Form No. 16 pertaining to the period for which such assessee was employed with each of the employers and Part B may be issued by each of the employers or the last employer at the option of the assessee.
4.6.3 The employer may issue a duplicate certificate in Form No. 16 if the deductee has lost the original certificate so issued and makes a request for issuance of a duplicate certificate and such duplicate certificate is certified as duplicate by the deductor.
4.6.4. Authentication by Digital Signatures:
(i)  Where a certificate is to be furnished in Form No. 16, the deductor may, at his option, use digital signatures** to authenticate such certificates.
(ii)  In case of certificates issued under clause (i), the deductor shall ensure that
 (a)  the conditions prescribed in para 4.6.1 above are complied with;
 (b)  once the certificate is digitally signed, the contents of the certificates are not amenable to change; and
 (c)  the certificates have a control number and a log of such certificates is maintained by the deductor.
Challan identification number (CIN) means the number comprising the Basic Statistical Returns (BSR) Code of the Bank branch where the tax has been deposited, the date on which the tax has been deposited and challan serial number given by the bank.
  •  The digital signature is being used to authenticate most of the e-transactions on the internet as transmission of information using digital signature is failsafe. It saves time specially in organisations having large number of employees where issuance of certificate of deduction of tax with manual signature is time consuming (Circular no. 2 of 2007, dated 21-5-2007)
4.6.5. Furnishing of particulars pertaining to perquisites, etc (Section 192(2C):
4.6.5.1 As per section 192(2C), the responsibility of providing correct and complete particulars of perquisites or profits in lieu of salary given to an employee is placed on the person responsible for paying such income i.e., the person responsible for deducting tax at source. The form and manner of such particulars are prescribed in Rule 26A, Form 12BA and Form 16 of the Rules. Information relating to the nature and value of perquisites is to be provided by the employer in Form 12BA in case salary paid or payable is above Rs.2,00,000/-. In other cases, the information would have to be provided by the employer in Form 16 itself.
4.6.5.2 An employer, who has paid the tax on perquisites on behalf of the employee as per the provisions discussed in paras 3.2 and 3.3 of this circular, shall furnish to the employee concerned, a certificate to the effect that tax has been paid to the Central Government and specify the amount so paid, the rate at which tax has been paid and certain other particulars in the amended Form 16.
4.6.5.3 The obligation cast on the employer under Section 192(2C) for furnishing a statement showing the value of perquisites provided to the employee is a crucial responsibility of the employer, which is expected to be discharged in accordance with law and rules of valuation framed there under. Any false information, fabricated documentation or suppression of requisite information will entail consequences thereof provided under the law. The certificates in Forms 16 and/or Rule 12BA specified above, shall be furnished to the employee by 31st May of the financial year immediately following the financial year in which the income was paid and tax deducted. If he fails to issue these certificates to the person concerned, as required by section 192(2C), he will be liable to pay, by way of penalty, under section 272A(2)(i), a sum which shall be Rs. 100/- for every day during which the failure continues.

Note :-

As per the guidelines issued by the Office of CCA, it is required to comply to the use of SHA-2 Hash Algorithm and 2048 bit RSA keys for digital signing. In view of the same, the following pre-requisites need to be followed:
  • JRE version : SUN-java 1.6_update29 or higher version (32 bit)
  • Client Operating system : Windows XP SP3, Vista Windows 7, Windows 2003 with patch for SHA-2.
  • I.E browser version supported : 7,8 and 9.
  • Safenet or E-token drivers used should be the latest (if applicable)

Benefit and Loss of Exemption from Income Tax against NSC.

National Saving Certificate (NSC) Interest Income is not exempt from Tax and it is fully taxable as limit of u/s. 80C.

According to Rule 15 the NSC (VII Issue) Rules, 1989 the interest on N.S.C shall accrue to the holder(s) of the certificate at the end of each year and the interest so accruing at the end of each year shall be deemed to have been re-invested on behalf of the holder and aggregated with the amount of face value of the certificate. So, Interest on N.S.C. should be offered for taxation on accrual basis every year. It may further be noted that the interest accrued every year is deemed as reinvested therein and is also eligible for deduction u/s 80C.

At the time of maturity, the reinvestment for purchase of another NSC’s, won’t make the interest income exempt from income tax.

Important 11 points while Converting ".TXT" or ".Zip" File of Form 16 & 16A into ".PDF" File.


As you know, Tin.nsdl has provided the complete procedure to convert form 16 and 16A zip file/text file to pdf file. Now a days many taxpayee are in big confusion about this issue as the form 16 and 16A are available to download from the tin website but converting the file to pdf was not easy. Therefore, I would like to share the complete procedure to convert form 16 and 16a zip file to pdf file.

Important 11 Points to Convert Form 16 & 16A zip file to Pdf File: 
  1. Extract Zip file containing TDS certificate data in text form by using WinZip version 9.0 and above, WinRaR version 3.90 and above and 7-Zip version 4.65 and above.
  2. Extract zip file by providing the TAN registration number.
  3. Open the “PDF converter utility” by double clicking the file “PDF Converter Utility.bat”.
  4. Click on “Browse” button of “Input File Name with Path” and provide path of Form 16/16A text files (see Fig 1.6 below). Example: files are selected from D drive. In case multiple file received select all the files in single browse.  
  5. Select the text file and click on button “Open” (see fig 1.6 above). Example: In case the text file pertains to Form 16A, files are copied at path D:\Form16A and the input file name is MUML00051C_201112_Q3_FORM_16A_0000001751_0001_OF_0001.txt.
  6. Click on “Browse” button of “Output File Path” and provide path where PDF file is to be created (see Fig 1.7 below). Example: the output file path is D:\Form16A.
  7. On selecting the location for saving the PDF file, click on “Open” button (see Fig 1.7 above).
  8. Select option to sign TDS certificate: Option to digitally sign or manually sign TDS certificate is available. a. Digital Signature (DSC): i. E-Token: To select DSC from e-Token, click on e-Token, provide the name of e-Token (by default the name provided in this field is eToken and the same may be changed) and provide the password in the field ‘E-Token Password’. Password is case sensitive (See Fig. 1.8).ii. Import DSC (.pfx file): To select .pfx file, click on ‘Import DSC (.pfx file)’ again click on browse and select the Digital Signature Certificate (DSC) and provide the DSC password in the field. ‘Digital Certificate Password’. Password is case sensitive. Click on ‘Detect Certificate’ (See Fig. 1.9).iii. DSC from Browser: To select DSC installed in browser, click on ‘DSC from Browser’. It will display DSC installed in browser. Select the DSC through which you wish to sign the PDF digitally (see fig. 1.10). b. Manual Signature: Select ‘manual signature’ to generate PDF. Utility will generate TDS certificate without signature. Deductor has to sign each certificate manually.
  9. Provide Details to be Printed on Form 16/16A (details of responsible person): a. Full Name: Provide full name of responsible person to be printed on PDF certificate.b. Designation: Provide designation of responsible person to be printed on Form 16A PDF. c. Father’s Name: Provide father’s name of responsible person to be printed on Form 16A PDF. d. Place: Provide place to be printed in ‘verification part’ of Form 16A PDF. e. Date: Provide date to be printed in ‘verification part’ of Form 16A PDF. Date should be in dd/mm/yyyy format.
  10. Click on “Generate PDF” button available on the Form 16/16A PDF converter utility window.
  11. On successful conversion of PDF files message “File generated successfully” will be provided (see Fig 1.10 below) and utility will generate the folder (folder name will be TAN_FORM16A_AY_Quarter_Date) which contain PDF of all the deductee PANs present in input file. Naming convention of pdf file for Form 16 is ‘PAN_FORM16_AY_Quarter.pdf’ and for Form 16A is ‘PAN_FORM16A_AY_Quarter.pdf’.

Terms and Conditions for Usage of Digital Signature Certificate

The digital signature usage is subject to various Indian laws and jurisdiction of courts, tribunals and authorities in India.

Wrong use of the digital signature certificate or its services shall be liable to be proceeded with civil and criminal consequences and shall be subjected to penalties and punishment. The Information Technology Act, 2000 rules provide for specific duties of subscribers as contained in Chapter VII of the Act.

In no event NSDL shall be liable for any indirect, incidental, special, consequential, punitive, reliance, cover or liquidated damages, including not but limited to loss of profits, revenue, data or use incurred by the other party, and resulting from the digital signature services offered by NSDL.

The digital signature certificate being used is for the purpose permitted for the corresponding class of the certificate. The aforementioned information has been read and understood.

Importance of Digital Signature while uploading of Income Tax Returns u/s. 140 of the IT Act, 1961.

All taxpayee well known about Digital Signature and its importance regarding e-filling of Income Tax Return. Most of taxpayee file their return through Tax Practitioner or from C.A. I would like to share some important features of Digital Signature as the awareness of e-filing of Income Tax return that how to file Income Tax Return by self and silent features of the Digital Signature and Income Tax Return e-Filing.

REGISTRATION PROCESS OF DIGITAL SIGNATURE AND UPLOAD OF INCOME TAX RETURNS USING DIGITAL SIGNATURE

A. The salient features of use of Digital Signature Certificate (DSC) for signing the Income Tax Return are as under:

1. As per Section 140 of the IT Act 1961, the person responsible for signing the I-T return can be, typically, the:
a) Managing Director or any other Director (in case the MD is unavailable) in case of a Company;
i. Any authorized person holding a legal power of attorney in case of a Non-resident Company;
b) Managing Partner in case of a Firm or any other Partner (in case the Managing Partner is unavailable);
c) Principal officer / Chief Executive Officer or Competent person in case of other entities such as Association of persons, Body of Individuals, Artificial Juridical person, Local Authority, Trust etc
d) Karta in case of a HUF;
e) Self in case of an Individual or;
i. Any authorized person holding a legal power of attorney in case the individual is incapable of signing the I-T Return or is absent from India.
2. Any person wishing to sign the I-T Return digitally has to complete the registration process for the DSC on the e-filing website- http://incometaxindiaefiling.gov.in prior to signing.
3. Any person could register his DSC to be used to sign the I-T Return of any entity provided he was a Director or Partner or Key Person as mentioned in the Key person Schedule of the I-T Return (ITRs 5 or 6) already filed electronically with the Income Tax Department.
4. Any person could register a DSC and use the same in his individual capacity to sign his own IT Return as well as sign the I-T returns in his various capacities as mentioned in 1 above, if required, and for as many entities as applicable.
5. Any person could change or update his DSC registration any number of times.

B. The existing procedure for registration of the DSC is as follows:

1. The authorized signatory / Individual would log into the E-filing websitehttp://incometaxindiaefiling.gov.in using the Login particulars such as the userid and password of the company / firm / HUF / Individual etc.
2. Under “My Account” he would have to select -> Update Digital Certificate or register the DSC at the time of creating the user on e-filing website at the time of initial registration:
3. The taxpayer has to select the appropriate type of DSC (.pfx or USB token) and click on ‘Select Your .PFX File Certificate’. At this stage, the Department would verify if the person holding the DSC matches the Director /Partner / Key Person in the Key Person Schedule of the Company (ITR-6) or Firm etc (ITR-5). If there is a match, i.e. the person registering the DSC is mentioned as a Director /Partner / Key Person, then the DSC would be registered against the Company / Firm / Entity PAN and the critical details such as the Sl no, Name etc would be stored. In this process, it is essential that at least one earlier I-T Return should have been filed by the Company / Firm / Entity so that the verification of key person is possible. In case an individual is registering the DSC for his own ITR (ITRs 1-4 case), then the email id as mentioned in the DSC should match the email id as per his registered profile in the efiling website. Now, the I-T Return for the Individual/HUF/Company / Firm / Entity PAN can be signed using this registered DSC.
4. At the time of uploading the I-T Return of the Company / Firm / Entity PAN, if the DSC is used for signing the I-T Return, the Department verifies,
i. if the DSC is registered;
ii. that the unique Sl No of the DSC used to sign the I-T Return is the same as the unique Sl No of registered DSC; and,
iii. the PAN number of the Verifier (Authorized Signatory) as mentioned in the Verification portion of the I-T Return, is the same as that of the person bearing the registered DSC; or
iv. in case of ITRs 1-4, the Individual logged in is the same as the person bearing the registered DSC, only then the I-T Return is permitted to be signed and uploaded.
5. Select appropriate type of DSC (.pfx or USB token) and click on ‘Next’ to proceed further to enter the DSC password and sign and upload the I-T return.

C. Amendment to Rule 12 – Making Digital Signature Mandatory for Companies

Vide notification dated 9th July 2010 amending Rule 12, the CBDT has made it mandatory all Companies filing ITR-6 to digitally sign the I-T return for AY 2010-11. In the following scenarios, taxpayers may find it difficult to register the DSC as per the existingprocedure as mentioned above:

1. Non-resident companies where the Directors are foreign nationals.
2. Companies where the I-T return is being filed for the first time
3. Companies where the Managing Director has changed and other Directors are either unavailable or also have changed.

In all such cases it is difficult to verify the identity of the person and his relationship with the Entity for which he is the authorized signatory. With a view to make registration simpler in such cases, the procedure has been changed to enable registration of a DSC where the PAN is also provided in the DSC as per the latest Interoperability guidelines issued by the Chief Controller of Certifying Authorities. Such DSCs with encrypted value of PAN are now available in the market. Refer to the new guidelines for DSC Interoperability issued by the CCA, Government of India in http://cca.gov.in/rw/resource/dsc_guidelines_r2.pdf?download=true wherein the Permanent Account Number (PAN) has been included in an encrypted format as an attribute (Page 50).

D. Changes in the process of Registration of DSC

In view of the above, a change is made in the registration process (as compared to sub-para 3 in para B above) for DSC as under:

Modified sub-para 3 of para B. The Authorized Signatory has the option

i. To select existing procedure to register the DSC, in case the scenarios mentioned in subparas 1, 2, or 3 in para C above are not applicable (the Authorized Signatory details must be already available in the previously filed I-T return of the Company/Firm/Entity, in which case he can continue to use his existing DSC issued prior to 01/08/2010); or
ii. To select new procedure as given below:

a. The Authorized Signatory must use a fresh DSC having encrypted value of his PAN, as issued by Certifying Authorities with effect from 01/08/2010.
b. Enter Authorized Signatory’s PAN number while registering the DSC. The same person must also enter the same PAN in the Verification portion of the I-T Return which he is signing in his capacity as Director/Partner/Karta/Authorized Signatory.
c. If the Authorized Signatory PAN number matches the encrypted value of the PAN present in the DSC – then the DSC will be registered after selecting the appropriate type of DSC (.pfx or USB token) and clicking on ‘Select Your .PFX File Certificate’.
d. In case of an Individual is registering his DSC for submitting own ITR (ITRs 1-4 case) then his PAN as per his login should match the encrypted PAN contained in the DSCthen the DSC will be registered after selecting the appropriate type of DSC (.pfx or USB token) and clicking on ‘Select Your .PFX File Certificate’.
e. Now, the I-T Return for the Self / Company / Firm / Entity PAN can be signed using this registered DSC.

The I-T Return upload process remains the same. If the DSC is used for signing the I-T Return, the Department verifies,
i. if the DSC is registered and in case DSC has been updated the DSC being used is the latest DSC registered;
ii. that the unique Sl No of the DSC used to sign the I-T Return is the same as the unique Sl No of registered DSC; and,
iii. the PAN number of the Verifier (Authorized Signatory) as mentioned in the Verification portion of the I-T Return, is the same as that of the person bearing the registered DSC; or
iv. in case of ITRs 1-4 the Individual logged in is the same as the person bearing the registered DSC, only then the I-T Return is permitted to be signed and uploaded.

The users belonging to above mentioned categories who have already registered their digital-signatures may continue to file this year's return also with same DSC. However, the users who are applying for new digital-signatures for registration and subsequent e-filing of returns are advised to apply for DSC-with-encrypted-PAN only.

S.O.1497(E).- In exercise of the powers conferred by section 295 read with section 139 of the Income-tax Act, 1961 (43 of 1961), the Central Board of Direct Taxes hereby makes the following rules further to amend the Income-tax Rules, 1962, namely:-

1. (1) These rules may be called the Income-tax (Sixth Amendment) Rules, 2011.
(2) They shall come into force from the date of its publication in the Official Gazette.
2. In the Income-tax Rules, 1962, in rule 12, in sub-rule (3), in the proviso, for clauses (a) and (aa) the following clause shall be substituted, namely: –

“ (a) a firm required to furnish the return in Form ITR-5 or an individual or Hindu Undivided Family (HUF) required to furnish the return in Form ITR-4 and to whom provisions of Section 44AB are applicable, shall furnish the return for Assessment year 2011-12 and subsequent Assessment Years in the manner specified in clause (ii);”

What is Digital signature?

A digital certificate authenticates electronic documents in a similar manner a handwritten signature authenticates printed documents. This signature cannot be forged and it asserts that a named person wrote or otherwise agreed to the document to which the signature is attached. The recipient of a digitally signed message can verify that the message originated from the person whose signature is attached to the document and that the message has not been altered either intentionally or accidentally since it was signed. Also, the signer of a document cannot later disown it by claiming that the signature was forged. In other words, digital signatures enable the "authentication" and “non-repudiation” of digital messages, assuring the recipient of a digital message of both the identity of the sender and the integrity of the message.

A digital certificate is issued by a Certification Authority (CA) and is signed with the CA's private key. A digital certificate typically contains the: Owner's public key, the Owner's name, Expiration date of the public key, the Name of the issuer (the CA that issued the Digital ID), Serial number of the digital certificate, and the digital signature of the issuer. After availing the digital certificate from a CA, the user can use it to electronically sign any document and the same is true for E-filing returns too.

Digital certificate deploy the Public Key Infrastructure (PKI) technology.

If you file electronically using digital certificate you do not have to submit a physical copy of the return. Efiling is possible even without digital certificate but the assessee shall furnish the Form ITR-V to the Income-tax Department by mailing it to “Income Tax Department – CPC, Post Bag No - 1, Electronic City Post Office, Bangalore - 560100, Karnataka” within thirty days after the date of transmitting the data electronically. The Post Bag shall deliver all the Form ITR-V to the Centralized Processing Centre (CPC) of the Income-tax Department in Bangalore. Upon receipt of the Form ITR-V, the CPC shall send an e-mail acknowledging the receipt of Form ITR-V. The e-mail shall be sent in due course to the e-mail address furnished by the tax-payers in his return. No Form ITR-V shall be received in any other office of the Income-tax Department or in any other manner.

In case, Form ITR-V, is furnished after the above mentioned period, it will be deemed that the return in respect of which the Form ITR-V has been filed was never furnished and it shall be incumbent on the assessee to electronically retransmit the data and follow it up by submitting the new Form ITR-V within thirty days.

It is now mandatory for the User to register / update the digital certificate incase if the user wants to use the digital certificate for e-fling the returns. Provision is available in the portal to register the digital certificate at the time of user registration or update of the Digital certificate after login from My Account services.
